To All Clients

Refund policies of companies usually contain the following information.
Refund methods: Businesses will usually give you a refund in the same way that you originally paid them.
Refund conditions: In most cases, a business cannot place fees or conditions on a refund or exchange.
Returning the product: You are generally responsible for returning the product if it can be posted or easily returned.
No refund signs and expired warranties
Businesses changing owners.
If you don’t have a service contract, you must at the very least have a refund policy for the sale of your services and products that clearly outlines the conditions under which a customer or client can receive a refund.

Practical tips

Before entering into a contract it is important to:

ensure that any advance payments are clearly stated as being deposits or part-payments.
consider including an express right to a refund of any advance payment (particularly for buyers) in the event of a breach.
consider how the payment obligations sit alongside any force majeure clauses; and
consider the size of the deposit being taken and whether it could amount to a penalty.

For advance payment refund advance payment refund guaranteeThe advance payment refund guarantee shall be submitted in the amount covering the requested advance payment including VAT, with the validity term of minimum 10 days from the date of signing the Record stipulated in Article 5 hereof. It should be submitted along with the advance invoice, within the term stipulated in Article 3paragraph 2 hereof at latest. The bank guarantee must be unconditional and collectable upon first call. It cannot contain additional payment conditions, shorter terms or smaller amounts than the ones determined by the contracting authority hereby or a different court jurisdiction for the dispute settlement. If the bidder submits the bank guarantee issued by a foreign bank, the bank must hold at least credit rating 3 (investment ranking). When submitting the bank guarantee, copies of specimen signature cards of authorized persons of the bank that issued the bank guarantee shall also be enclosed. The bank guarantees shall be kept in the Buyer’s portfolio until all the obligations have been executed, whereupon they shall be returned to the other contracting party. Should timeframe for the execution of the contractual obligations change during the validity term of the contract, or some other circumstances which prevent the completion of contractual obligations, the validity of bank guarantee must be extended.
